The Site describes our user-acquisition services. Nothing on the Site is an offer, a guarantee of results, or a binding commitment to provide services. Campaign results vary, and statements on the Site about our methods, systems, or past performance are illustrative.
Any services we provide to a partner are governed exclusively by a separate written agreement, such as an insertion order, executed between KPI Fuel and that partner. In the event of any conflict between these Terms and a services agreement, the services agreement controls.
You agree not to misuse the Site, including by attempting to gain unauthorized access to any systems, interfering with the Site's operation, scraping or harvesting data at scale, or using the Site for any unlawful purpose.
Access to the partner console is provisioned by us for active partners and is subject to the applicable services agreement. You are responsible for safeguarding your credentials and for activity under your account.
The Site and its content, including text, graphics, designs, and software, are owned by KPI Fuel or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site without our prior written consent.
Our services involve third-party platforms, including TikTok. We are not affiliated with, endorsed by, or sponsored by TikTok or its parent companies. Third-party platforms are governed by their own terms and policies.
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, KPI Fuel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from or related to your use of the Site.
We may revise these Terms from time to time. The effective date above reflects the latest revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the state in which KPI Fuel LLC is organized, without regard to conflict of law principles.
